In a significant move, President Bola Tinubu has invoked the Principle of the Presidential Prerogative of Mercy, allowing for the waiver of the “No Work, No Pay” Order imposed on striking members of the National Association of Resident Doctors (NARD).
This order had been instituted on August 1, 2023, following the commencement of their industrial action that began on July 26, 2023.
The decision to waive the “No Work, No Pay” order was announced in a statement by the Special Adviser to the President on Media and Publicity, Ajuri Ngelale, in Abuja on Friday.

The statement outlined the background and context: “After several constructive engagements between the Federal Government and NARD, the Resident Doctors called off their strike on August 12, 2023. The Office of the Accountant General of the Federation was directed to withhold all salaries accrued by striking NARD members during the 17 days of their strike action.”
The President’s directive, therefore, allows for the exceptional last waiver of the “No Work, No Pay” order on Resident Doctors. However, this waiver comes with a mandatory requirement. It necessitates that the Federal Ministry of Health and Social Welfare, along with the Federal Ministry of Labour and Employment, must secure a Document of Understanding (DoU) that establishes this exceptional waiver granted by the President as the final one for the National Association of Resident Doctors and all other Health Sector Unions.
This decision reflects a commitment to addressing the concerns of the Resident Doctors and acknowledges the importance of their work in the healthcare sector. It is hoped that this gesture will further enhance the working relationship between the government and the medical professionals while ensuring that the interests of both parties are duly protected.
