Nnamdi Kanu’s hope of regaining freedom encountered a setback as the Supreme Court, in a significant ruling, nullified the Court of Appeal’s judgment that directed the Federal Government to release him from detention.
Acknowledging the government’s “irresponsible” action in forcibly bringing Kanu back to Nigeria from Kenya, a move that disregarded established laws, the apex court unanimously recognized that this action wasn’t sufficient to strip the trial court of its jurisdiction to continue with Kanu’s case.
In a judgment primarily prepared by Justice Garba Mohammed but read by Justice Emmanuel Agim, the Supreme Court clarified that there’s no existing legislation depriving the trial court of its authority to proceed with the case, despite the government’s unlawful actions against Kanu.

The court emphasized that Kanu’s recourse should have been to file a civil action against the government instead of expecting a direct release through legal channels.
While reprimanding the Federal Government, the court highlighted the importance of the government being mindful of its reputation both locally and internationally. It also criticized the trial court for revoking Kanu’s bail after he fled to safeguard his life during a security agency’s incursion into his residence.
Nnamdi Kanu, initially arrested by security agents in Lagos on October 14, 2015, has remained in detention since June 29, 2021, prompting ongoing legal battles and controversies surrounding his case.
