Request for Recusal
Nnamdi Kanu, the leader of the Indigenous People of Biafra (IPOB), asked Justice Binta Nyako to recuse herself from his ongoing trial at the Federal High Court in Abuja on Tuesday.
Kanu expressed his distrust in the court’s impartiality, accusing Justice Nyako of failing to adhere to a Supreme Court decision in his case.
Interruptions and Direct Appeal
Kanu interrupted his lawyer, Mr. Alloy Ejimakor, who was requesting a trial suspension due to Kanu’s lack of preparation time. Kanu then directly addressed the judge, citing the Supreme Court ruling that questioned the court’s impartiality and insisted Justice Nyako withdraw from the case.

Opposition from the Prosecution
Despite opposition from the prosecution led by Mr. Adegboyega Awomolo, who argued that the Supreme Court’s directive was for the trial to proceed, Justice Nyako decided to recuse herself, returning the case to the Chief Judge.
Background on Nnamdi Kanu’s Case
Kanu, who was arrested in 2015 and granted bail in 2017, was re-arrested in 2021 after fleeing the country. His trial has been marred by legal battles, including the striking out of some charges by the Court of Appeal and ongoing Supreme Court proceedings.
