Femi Falana: Judiciary Shouldn’t Determine Election Winners

Femi Falana, SAN, a well-known human rights attorney and activist, has stated that he believes the judiciary should not decide who wins elections. In an interview with Politics Today on Channels TV, he made this claim.

Falana contends that the Independent National Electoral Commission (INEC) should be the only body tasked with declaring the winners of elections. He stated that the controversy surrounding the presidential election has been resolved by the Supreme Court’s recent ruling, but it should not be interpreted as a court endorsing INEC’s actions.

Falana stressed that, if everything is done properly, INEC should be in charge of deciding election results rather than courts. In order to gain respect from around the world, he demanded that the practice of the judiciary selecting election winners halt. He also emphasized that Nigeria, the country with the largest black population, had a big duty to hold credible, transparent, and fair elections.

The attorney further emphasized that if the political elite is dedicated to integrity and fair play, holding transparent elections is not a difficult undertaking.

Following the Supreme Court’s decision to maintain President Bola Tinubu’s election victory while rejecting petitions from Peter Obi of the Labour Party (LP) and Atiku Abubakar of the Peoples Democratic Party (PDP), Femi Falana made this statement. The seven-judge panel headed by Justice John Okoro rejected the opposition’s arguments, which claimed Tinubu was ineligible, that there had been fraud, and that election law had been broken.
