In a significant development, the impeachment investigation panel probing Edo State’s Deputy Governor, Rt. Hon Philip Shaibu, chaired by retired Justice S.A. Omonuwa, has announced its decision to continue with the investigation despite legal objections.
The panel’s decision came after objections raised by Professor Oladoyin Awoyale (SAN), the counsel representing Shaibu, citing an order from the Abuja Federal High Court postponing the case to April 8, 2024.
Awoyale argued that the adjournment was intended for all parties to present reasons why the court should either grant or deny the request for an interlocutory injunction against the impeachment proceedings initiated by the Edo State House of Assembly. However, Justice Omonuwa clarified that the Federal High Court had only instructed the parties to present their arguments and had not prohibited the investigation.

Deputy Clerk, Legal, Edo State House of Assembly, Ohiafi Joe, countered Awoyale’s argument, citing constitutional provisions that empower the House of Assembly and the investigation panel to carry out their duties without interference from the courts. He emphasized that Awoyale needed to demonstrate that the constitutional provision had been altered for his argument to hold.
Following deliberations, the panel chairman affirmed that the investigation would proceed and requested the House of Assembly to present its case. Awoyale then requested permission to withdraw from the proceedings, stating that his client would not participate further. However, he clarified that Shaibu was not waiving his right to defend himself but adhering to the court’s directive to appear before it.
