A Federal Capital Territory High Court has ruled to strike out two separate fundamental rights enforcement suits brought by George Emefiele and Okanta Emefiele, siblings of the suspended Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele.
The suits were filed against the Attorney General of the Federation (AGF) and the Department of State Services (DSS).
The two brothers had sought an order of perpetual injunction restraining the DSS from inviting, intimidating, harassing, arresting, or detaining them in connection with the ongoing investigation of the suspended CBN governor by the DSS.

During the resumed hearing of the cases on Wednesday, Grace Ehusani, the counsel for the applicants, informed the court that both applicants had filed separate notices of discontinuance of the cases. However, no reasons were provided for the withdrawal of the cases.
Ibrahim Awo, the counsel for the DSS, urged the court to dismiss the cases instead of merely striking them out, as requested by the applicants’ counsel. Awo also proposed that a cost of N2 million should be imposed on the applicants in favuor of the respondents. Maimuma Lami-Sheru, counsel for the AGF, concurred with Awo’s request.
In the ruling, Justice Emmanuel Okpe, the presiding judge, granted the request to strike out the cases. The judge also determined that no costs would be borne by the applicants.
The decision of the court to strike out the cases signifies the conclusion of the legal proceedings initiated by the Emefiele siblings against the AGF and the DSS. The ruling asserts that the applicants have voluntarily discontinued their legal action without specifying the reasons behind their decision.
